Terms of Service

1. What lovely-companion is

lovely-companion is a digital companion offering conversation, stories, games, calm activities, and ways to stay connected with family and friends during hospital stays, recovery and days at home.

It is not a medical service. It does not diagnose, treat, prescribe, monitor health, or replace doctors, nurses, therapists or caregivers. Never use it for emergencies — call 911 (or your local emergency number). See our Safety page.

2. Who can use it

• You must be at least 18, or have permission from a parent or legal guardian who agrees to these terms for you.
• Children under 13 may use lovely-companion only with an account set up and supervised by a parent or guardian.
• Give accurate information, keep it updated, and keep your password private. You are responsible for activity on your account.

3. Your licence

We give you a limited, personal, non-exclusive, non-transferable right to use lovely-companion within your chosen plan. SmartMindsUSA LLC owns the service, its software, content, design and branding. You may not copy, resell, reverse engineer, or get around technical limits of the service.

4. Acceptable use

You agree not to:

• use the service for anything unlawful, fraudulent, or for spam;
• harass, threaten or hurt others, including family members or friends you connect with;
• upload content you don't have the rights to, or that infringes someone's intellectual property;
• interfere with security — including malware, probing, scraping or overloading the service;
• try to make the AI companion produce illegal, hateful, sexual or harmful content, impersonate real people, or bypass its safety rules ("jailbreaking").

5. The AI companion

• Replies are generated by artificial intelligence. They can be wrong, incomplete or unsuitable. Don't rely on them for medical, legal, financial or other professional advice.
• You are responsible for what you type and how you use replies.
• We may filter replies, remove content, or restrict accounts to keep people safe.

6. Your content

You keep ownership of messages, photos and voice notes you share. You give us a limited permission to store and process them only to provide the service to you and the people you choose. If you believe content infringes your rights, email hello@smartmindsusa.com; we will review it and may remove it. Repeated infringement leads to account termination.

7. Family and friends

Family members you link with and friends you approve see only what the app's privacy rules allow. You can remove family links, and mute or remove friends, at any time. Treat the people you connect with kindly.

8. Plans, payment and cancellation

Some features are free. Paid plans (Individual and Family, monthly or yearly) start with a 7-day free trial and then renew automatically until you cancel. You can cancel anytime from the Me or Plans page; you keep access until the end of the period you paid for. If you cancel during the trial, you are not charged.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations and refunds are also covered by Paddle's Buyer Terms. See our Refund Policy.

9. Availability

We work hard to keep lovely-companion running, but we can't promise it will always be available, uninterrupted or error-free. We may change or improve features over time.

10. Suspension and ending your account

We may suspend or end access for a serious or repeated breach of these terms, non-payment, or a security or fraud risk. You can delete your account anytime from the Me page; your personal data is then deleted as described in our Privacy Policy.

11. Disclaimers and liability

To the fullest extent permitted by law, the service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose. We are not liable for indirect, incidental or consequential losses (such as loss of profits, data or goodwill). Our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing here limits liability for fraud, death or personal injury where the law doesn't allow it.

You agree to cover claims against us that result from your content, your unlawful use, or your breach of these terms.

12. General

These terms are governed by the laws of Indiana, United States, and disputes will be handled by its courts, unless your local consumer law gives you other rights. We aren't responsible for delays caused by events beyond reasonable control. You may not transfer these terms without our consent; we may transfer them as part of a merger or sale. We may update these terms and will tell you about important changes in the app.
